Internet Services Internet access. You -re the end user hereinto referred to -s
(“User”). By signing up for the service, you -accept all of the terms -nd conditions
(“Terms -nd Conditions”) set forth below, -nd in -any -addend- to this -agreement,
and authorize us to provide the Services (-s defined below) for - period -greed to
upon pl-cing -n order for the Services (the “Initial Term”).
PLEASE CAREFULLY READ AND REVIEW THE TERMS AND CONDITIONS BEFORE
USING THE EQUIPMENT OR THE SERVICE. BY USING THE SERVICES YOU ARE
BECOMING A PARTY TO AND AGREE TO BE BOUND BY THIS AGREEMENT. YOU
FURTHERMORE ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE
TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THE TERMS AND
CONDITIONS IN EFFECT AND AS UPDATED BY US FROM TIME TO TIME. IN
ADDITION, BY PLACING AN ORDER FOR THE SERVICES, YOU ACKNOWLEDGE
THAT WE WILL COMMENCE PROCESSING SUCH ORDER AND WILL INCUR
EXPENSES AND OBLIGATIONS IMMEDIATELY. IF YOU DO NOT AGREE TO BE
BOUND BY THE TERMS AND CONDITIONS, YOU MAY NOT USE THE SERVICES
AND YOU SHOULD CANCEL YOUR ORDER. IF YOU DO NOT AGREE TO BE BOUND
BY THE TERMS AND CONDITIONS, WE WILL BE UNDER NO OBLIGATION TO
PROVIDE YOU WITH THE SERVICES.
THE TERMS AND CONDITIONS ARE SUBJECT TO REVISION FROM TIME TO TIME.
IMPORTANT! THE HOTEL WIRELESS SYSTEM YOU ARE USING IS AN UNSECURED
NETWORK. YOU SHOULD USE APPROPRIATE SECURITY MEASURES SUCH AS A
VPN CONNECTION, PERSONAL FIREWALL, KEEP YOUR OPERATING SYSTEM UPTO-
DATE WITH SECURITY PATCHES, ETC.
Here -re - few security recommendations:
Disable the wireless cards -d-hoc (peer-to-peer) mode. This c-n be done vi- the
adapterʼs utilities or within Windows XP. Remove or dis-ble the wireless c-rd if
you -re working offline.
Inst-ll - person-l firew-ll. Windows XP offers - b-sic firewall, but - more
-dv-nced person-l firewall c-n prevent others from -ccessing - l-ptop. Inst-ll -
person-l -ntivirus softw-re.
T-ke -dv-nt-ge of the em-il clientʼs security fe-tures, p-rticul-rly digit-l
sign-tures -nd em-il encryption. Digit-l sign-tures verify your identity to your
recipients -nd ensure th-t mess-ges -re not t-mpered with. M-ke sure you
submit credit-c-rd inform-tion only to SSL-protected web sites (look for https:// in
the -ddress b-r). Keep your OS -nd softw-re up to d-te with security p-tches.
Computer Equipment
User -grees to purch-se network -ccess services (“Services”) from us. We or our
contr-ctor h-s provided User with m-teri-ls, which set forth the minimum
h-rdw-re -nd oper-ting system requirements necess-ry to use the Services. User
represents -nd -grees th-t User h-s reviewed those m-teri-ls -nd th-t the
computer in which the Equipment will be inst-lled meets these minimum
requirements.
Equipment Provided
We, or our -gent or contr-ctor m-y provide User with - r-dio, -n -ntenn-, -nd
cert-in softw-re (collectively the “Equipment”). We m-y -lso provide - user
m-nu-l th-t cont-ins instructions for setting up -nd using the Equipment. The
Equipment provided by us, if inst-lled -nd used properly, -llows the User to
-ccess -nd use the Services.
Services
Services provided by us -re for the sole use of the User -nd not for res-le of -ny
kind without the prior written consent from us, which m-y be given -t its sole
discretion. In the event the User -ttempts to resell the Services, we m-y, -t our
sole discretion, incre-se the fees -ssoci-ted with the Services, or termin-te the
Services.
Billing
User -grees to p-y -ll ch-rges to Userʼs -ccount, including recurring fees,
-pplic-ble t-xes -nd ch-rges to recover t-xes p-id, in -ccord-nce with billing
terms in effect -t the time the fee or ch-rge becomes p-y-ble. User -grees to
provide us with -ccur-te -nd complete billing inform-tion, including Userʼs leg-l
n-me, -ddress, telephone number -nd credit c-rd inform-tion. User -grees to
report to us -ll ch-nges to this inform-tion within thirty (30) d-ys of -ny ch-nge,
including -ny ch-nge in the expir-tion d-te of Userʼs credit c-rd. The recurring
fee is due -nd p-y-ble in -dv-nce of the respective billing period for which the
User h-s purch-sed Services, with the first p-yment due -nd p-y-ble on the
-ctiv-tion d-te of the Services. User -grees to p-y - fee for processing unp-id
checks or rejected credit c-rds. Activ-tion -nd us-ge fees -re non-refund-ble.
The initi-l p-yment m-y include non-recurring inst-ll-tion ch-rges including, but
not limited to equipment -nd -ctiv-tion fees. Delinquent -ccounts -re subject to
immedi-te termin-tion or suspension of Services -t the sole discretion of us. If
p-yment is not received by us within fifteen (15) d-ys from the d-te p-yment is
due, Userʼs -ccount is considered delinquent -nd User will be subject to - l-te
p-yment fee of 1.5% per month of the outst-nding b-l-nce on Userʼs -ccount or
$15 doll-rs, whichever is gre-ter (not to exceed the m-ximum r-te permitted by
l-w). User is -lso responsible for -ll -ttorney -nd collection fees -rising from our
efforts to collect -ny unp-id b-l-nce.
Intended Use of the Services
User -cknowledges -nd -grees th-t the Services -re for person-l use -nd -grees
not to use the Services in - m-nner prohibited by -ny feder-l or st-te l-w or
regul-tion. User further -grees to -dhere to our Accept-ble Use Policy (“AUP”)
which is -v-il-ble on our Account M-n-gement website. Tr-nsmission of -ny
m-teri-l in viol-tion of feder-l or st-te l-w or regul-tion, including, but not limited
to -ny copyrighted m-teri-l, m-teri-l protected by - tr-de secret or m-teri-l or
mess-ges th-t -re unl-wful, h-r-ssing, libelous, -busive, thre-tening, h-rmful,
vulg-r, obscene or otherwise objection-ble in -ny m-nner or n-ture or th-t
encour-ges conduct th-t could constitute - crimin-l offense, give rise to civil
li-bility or otherwise viol-te -ny -pplic-ble loc-l, st-te, n-tion-l or intern-tion-l
l-w or regul-tion, is prohibited.
User -cknowledges th-t there is content on the Internet or otherwise -v-il-ble
through the Services which m-y be offensive, or which m-y not be in compli-nce
with -ll loc-l l-ws, regul-tions -nd other rules. We -ssume no responsibility for
-nd exercises no control over the content cont-ined on the Internet or is
otherwise -v-il-ble through the Services. All content -ccessed or received by the
User is used by User -t his or her own risk, -nd we -nd our employees sh-ll h-ve
no li-bility resulting from the -ccess or use of such content by the User.
System -nd Network Security
Users m-y not -ttempt to circumvent user -uthentic-tion or security of -ny host,
network, or -ccount (-lso known -s “cr-cking”). This includes, but is not limited
to, -ccessing d-t- not intended for the User, logging into - server or -ccount the
User is not expressly -uthorized to -ccess, or probing the security of other
networks.
Users m-y not -ttempt to interfere with service to -ny user, host, or network
(“deni-l of service -tt-cks”). This includes, but is not limited to, “flooding” of
networks, deliber-te -ttempts to overlo-d - service, -nd -ttempts to “cr-sh” -
host.
Users m-y not use -ny kind of progr-m/script/comm-nd, or send mess-ges of
-ny kind, designed to interfere with - userʼs termin-l session, vi- -ny me-ns,
loc-lly or by the Internet.
Users who viol-te systems or network security m-y incur crimin-l or civil li-bility.
We will cooper-te fully with investig-tions of viol-tions of systems or network
security -t other sites, including cooper-ting with l-w enforcement -uthorities in
the investig-tion of suspected crimin-l viol-tions.
Users underst-nd th-t there -re cert-in security risks by utilizing wireless 802.11x
networks. We -re committed to m-int-ining - public network for e-se of use -nd
m-ke no gu-r-ntees or represent-tions reg-rding the security of our network. We
recommend the use of person-l firew-ll softw-re -nd - VPN client to -tt-ch to
priv-te networks. As -n option, we support rout-ble IP -ddresses to -ll
connection types to support - corpor-te VPN.
Priv-cy; Monitoring the Services
We -re under no oblig-tion to monitor the services, but we m-y do so from time to
time -nd we m-y disclose inform-tion reg-rding Userʼs use of the Services for
-ny re-son -nd -t our sole discretion in order to s-tisfy -pplic-ble l-ws,
regul-tions, government-l requests, or in order to oper-te -nd deliver the
Services in -n effective m-nner, or to otherwise protect us -nd our Users. We
-gree to comply with the terms of our Priv-cy Policy -s set forth on our FAQ
website, -s it m-y be -mended from time to time.
IP Addresses
IP -ddresses -re norm-lly -ssigned on - dyn-mic b-sis -nd there is little or no
-ssur-nce th-t the User will be -ssigned the s-me (or even simil-r) IP -ddress
between sessions.
Restrictions
Users -gree not to run -ny servers in conjunction with the Services, including but
not limited to, electronic m-il, NAT, DHCP -nd DNS servers. In the event -ny User
-ttempts to utilize - server on the network, we m-y, -t our sole discretion,
incre-se the fees -ssoci-ted with the Services, or termin-te the Services.
Term/C-ncell-tion
User -grees to m-int-in Services for the dur-tion of the Initi-l Term. After the
Initi-l Term, Services sh-ll -utom-tic-lly renew for successive periods equiv-lent
to the Initi-l Term. User m-y termin-te the Services -t the end of the Initi-l Term
or -t -ny time during -ny renew-l term by providing not less th-n thirty (30) d-ys
written notice to us. Termin-tion notice must be sent to the -ddress loc-ted on
our FAQ website.
Reconnect Fee
If the Services -re termin-ted due to non-p-yment -nd/or bre-ch of the Terms
-nd Conditions or ACCEPTABLE USE POLICY, User -grees to p-y - reconnection
fee, if Services -re re-ctiv-ted.
Discl-imer of Li-bility
THE SERVICES PROVIDED BY US ARE PROVIDED “AS IS.” WE MAKE NO
WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT
LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE OR NON-INFRINGEMENT, OR ANY WARRANTY
REGARDING THE RELIABILITY OR SUITABILITY FOR A PARTICULAR PURPOSE OF
ITS SERVICES. USER UNDERSTANDS AND ACKNOWLEDGES THAT WE EXERCISE
NO CONTROL OVER THE NATURE, CONTENT OR RELIABILITY OF THE
INFORMATION AND/OR DATA PASSING THROUGH OUR NETWORK. NO ORAL OR
WRITTEN INFORMATION OR ADVICE GIVEN BY US, ITS DEALERS, AGENTS OR
EMPLOYEES SHALL CREATE A WARRANTY AND USER MAY NOT RELY ON ANY
SUCH INFORMATION OR ADVICE. WE MAKES NO WARRANTY OF ANY KIND,
EITHER EXPRESSED OR IMPLIED, REGARDING THE QUALITY, ACCURACY OR
VALIDITY OF THE INFORMATION AND/OR DATA RESIDING ON OR PASSING
THROUGH ANY NETWORK. USE OF ANY INFORMATION AND/OR DATA OBTAINED
FROM OR THROUGH SERVICES PROVIDED BY US WILL BE AT USERʼS OWN RISK.
USER ACKNOWLEDGES THAT WE ARE NOT LIABLE FOR ANY ERRORS OR
INTERRUPTION IN THE INSTALLATION PROCESS OR IN PROVIDING THE
SERVICES, WHETHER WITHIN OR OUTSIDE THE CONTROL OF US. UNDER NO
CIRCUMSTANCES SHALL THE USER HOLD US OR ANY OF OUR AGENTS,
CONTRACTORS OR REPRESENTATIVES RESPONSIBLE FOR ANY FORM OF
DAMAGES OR LOSSES (INCLUDING WITHOUT LIMITATION ANY DIRECT,
INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR LOSSES) SUFFERED
FROM, BUT NOT LIMITED TO ERRORS, DELAYS, LOSS OF INFORMATION, DELAYS
IN THE INSTALLATION OR PROVISIONING PROCESS, OR INTERRUPTIONS IN THE
SERVICES CAUSED BY THE USER, US OR A THIRD PARTYʼS NEGLIGENCE, FAULT,
MISCONDUCT OR FAILURE TO PERFORM. USER UNDERSTANDS THAT
TELECOMMUNICATION AND/OR NETWORK ACCESS SERVICES MAY BE
TEMPORARILY UNAVAILABLE FOR SCHEDULED OR UNSCHEDULED
MAINTENANCE AND FOR OTHER REASONS WITHIN AND OUTSIDE OF THE
DIRECT CONTROL OF US. UNDER NO CIRCUMSTANCES DO ANY SUCH ERRORS,
DELAYS, INTERRUPTIONS IN SERVICES OR LOSS OF INFORMATION NULLIFY OR
MODIFY THESE TERMS AND CONDITIONS. WE RESERVE THE RIGHT TO REFUSE
OR TERMINATE SERVICES TO A USER AT ANY TIME WITHOUT CAUSE. THE
INTERNET CONTAINS UNEDITED MATERIALS, WHICH MAY BE SEXUALLY
EXPLICIT, OR MAY BE OFFENSIVE TO YOU OR OTHERS ACCESSING THE
SERVICES. WE HAVE NO CONTROL OVER SUCH MATERIALS AND ACCEPT NO
RESPONSIBILITY FOR SUCH MATERIALS.
User Compl-int Resolution
In order to resolve - compl-int reg-rding the Services or to receive further
inform-tion reg-rding the use of the Services, User should cont-ct us -t the
-ddress -nd phone number listed on our website.
Addition-l Terms -nd Conditions
We m-y, from time to time, send e-m-il mess-ges or other forms of
communic-tion to User cont-ining -dvertisements, promotions, etc. which m-y be
offered by third p-rties. We m-ke no represent-tion or w-rr-nty with respect to
the content of -ny such third p-rty communic-tions or goods or services which
m-y be obt-ined in response to such communic-tions -nd User -grees th-t we
sh-ll not h-ve -ny li-bility with respect thereto, nor sh-ll -ny such mess-ges
-mend the Terms -nd Conditions unless specific-lly -greed to in writing by us.
Addition-lly, our web site m-y cont-in links to Web sites oper-ted by p-rties other
th-n us. Such links -re provided for your convenience only. We do not control such
Web sites -nd is not responsible for their contents. Our inclusion of links to such
Web sites does not imply -ny endorsement of the m-teri-l on such Web sites or
-ny -ssoci-tion with their oper-tors.
Entire Agreement
The Services Order Confirm-tion -nd Acknowledgement Terms -nd Conditions,
the Terms -nd Conditions, the Accept-ble Use Policy -nd the Priv-cy Policy
cont-in the entire -greement -nd underst-nding concerning the Services -nd
supersede -ll prior negoti-tions, proposed -greements, -nd -ll other -greements,
whether electronic, written or or-l. The Terms -nd Conditions m-y be modified -t
-ny time by us -nd the l-test version of the Terms -nd Conditions m-y be found
on our FAQ website. A printed version of these Terms -nd Conditions -nd of -ny
notice given in electronic form sh-ll be -dmissible in judici-l or -dministr-tive
he-rings b-sed upon or rel-ting to the Terms -nd Conditions to the s-me extent
-nd subject to the s-me conditions -s other business documents -nd records
origin-lly gener-ted -nd m-int-ined in printed form.
Assignment -nd Successors in Interest
All of the Terms -nd Conditions sh-ll be binding upon, inure to the benefit of, -nd
be enforce-ble by the respective successors -nd permitted -ssigns of User.
Except -s specific-lly st-ted herein, neither these Terms -nd Conditions nor -ny
of the rights, interests or oblig-tions of User or us sh-ll be -ssigned or deleg-ted
without the prior written consent of us. Any un-uthorized -ssignment or
deleg-tion sh-ll be null -nd void. Notwithst-nding the foregoing, we m-y -ssign
or otherwise tr-nsfer its rights -nd oblig-tions to -ny -ffili-te (whether by
purch-se of stock or -ssets, merger, oper-tion of l-w, or otherwise) of th-t
portion of its business rel-ted to the subject m-tter hereof.
Venue/Choice of L-w
These Terms -nd Conditions sh-ll be construed in -ccord-nce with the l-ws of
the St-te of New Jersey (excluding rules reg-rding conflicts of l-w) -nd the
United St-tes of Americ-. In the event of -ny dispute, the p-rties submit to the
person-l jurisdiction of -nd venue Atl-ntic City, NJ.
Sever-bility
In the event th-t it is determined by - court of competent jurisdiction -s - p-rt of
- fin-l non--ppe-l-ble judgment th-t -ny provision of these Terms -nd
Conditions (or p-rt thereof) is inv-lid, illeg-l, or otherwise unenforce-ble, such
provision will be enforced -s ne-rly -s possible in -ccord-nce with the st-ted
intention of the p-rties, while the rem-inder of the Terms -nd Conditions will
rem-in in full force -nd effect.
Indemnific-tion
User sh-ll indemnify -nd hold us h-rmless -g-inst -ny -nd -ll cl-ims, losses,
d-m-ges -nd li-bilities sust-ined by User resulting from, rising out of, or
connected with -ny bre-ch of, or non-fulfillment of -ny represent-tion, w-rr-nty,
coven-nt or -greement m-de by or other oblig-tion of User cont-ined in these
Terms -nd Conditions.
